2. Collection and storage of personal data as well as type and purpose of their use

a) When visiting the website

When accessing our websites under the TLD www.lsv-legal.com (hereinafter only: website), information is automatically sent to the servers of the hosting service provider of our website by the browser you use on your device. The hosting services for www.lsv-legal.com are provided for the LSV Group by the company domainfactory GmbH, Oskar-Messter-Str. 33, 85737 Ismaning, Federal Republic of Germany, www.df.eu. When the website is accessed, a direct connection to their servers is established for the duration of the visit. The following information is collected without your intervention and stored until it is automatically deleted:

  • the IP address of the requesting computer (user),
  • date, time and duration of the access,
  • name and URL of the retrieved file,
  • information about the browser type and used version used as well as the browser language,

  • the website from which access is made (Referrer-URL),

The information in conjunction with the visit of the website is temporarily stored in a so-called web server log file and is automatically deleted after 7 days at the latest.

The mentioned data will be processed by us for the following purposes:

  • ensuring a smooth connection to the website,
  • ensuring a comfortable use of our website,
  • evaluation of system security and stability as well as
  • for other administrative purposes.

The legal basis for the temporary storage of data and web server log files is provided by art. 6 para. 1 sentence 1 lit. f GDPR. Our legitimate interest is derived from the above-listed purposes for data collection. Under no circumstances do we use the data collected for the purpose of drawing conclusions about you personally.

The collection of data for the provision of the website and the storage of data in web server log files are a necessary requirement for the operation of the website. Consequently, there is no possibility of objection on the part of the user.

In addition, we use cookies and analysis services when you visit our website. You will find more detailed explanations under sections 4 and 5 of this data privacy statement.

b) When registering for our newsletter

If you have expressly consented, we will use your e-mail address to send you our newsletter on a regular basis, in accordance with art. 6 para. 1 sentence 1 lit. a GDPR. To receive the newsletter, it is sufficient to provide an e-mail address.

There will be no transfer of personal data to third parties for purposes other than those listed below.

Your personal data will only be passed on to third parties:

  • if the disclosure pursuant to art. 6 para. 1 sentence 1 lit. f GDPR is necessary to assert, exercise or defend legal claims and if there is no reason to assume that you have an overriding interest worthy of protection in not disclosing your data,
  • in the event that a legal obligation exists for the transfer pursuant to art. 6 para. 1 sentence 1 lit. c GDPR, and
  • if this is legally permissible and is necessary for the handling of contractual relationships with you pursuant to art. 6 para. 1 sentence 1 lit. b GDPR.

Within the scope of our website, pages/information with content in german language originating from Ernst Röbke publishing house www.erv-online.de are also used in the german part under "News".  When you visit the websites listed under "News", your browser establishes a direct connection to the server of the third-party provider. They may store your IP address for statistical purposes. These data cannot be assigned to specific persons. The data will be deleted automatically.

4. Cookies

When accessing the website, the user was informed about the use of cookies for analytical purposes and his or her consent to the processing of personal data used in this context was obtained. In this context, reference was also made to this data privacy statement.

We use third party cookies on our website (see section 5). These are small files that your browser automatically creates and that are stored on your device (desktop, laptop, tablet, smartphone, etc.) when you visit our website. 6. Rights of the persons affected

As a natural person you have the right:

  • in accordance with art. 15 GDPR, to request information about your personal data processed by us. In particular, you may request information about the purposes of processing, the category of personal data, the categories of recipients to whom your data have been or will be disclosed, the planned storage period, the existence of a right to rectification, deletion, restriction of processing or objection, the existence of a right of appeal, the origin of your data, if these have not been collected by us, and the existence of automated decision-making including profiling and, if applicable, meaningful information on their details;
  • in accordance with art. 16 GDPR, to demand the immediate correction of incorrect or the completion of your personal data stored by us;
  • in accordance with art. 17 GDPR, to demand the deletion of your personal data stored by us, unless the processing is necessary to exercise the right to freedom of expression and information, to fulfil a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims;
  • in accordance with art. 18 GDPR, to demand the restriction of the processing of your personal data if you dispute the accuracy of the data, if the processing is unlawful but you refuse its deletion and we no longer need the data, but if you need it to assert, exercise or defend legal claims or if you have filed an objection against the processing in accordance with art. 21 GDPR;
  • in accordance with art. 20 GDPR, to receive the personal data you have provided to us in a structured, current and machine-readable format or to request its transfer to another person responsible;
  • in accordance with art. 7 para. 3 GDPR, to revoke your consent given to us at any time. As a result, we are no longer allowed to continue processing data based on this consent in the future, and
  • in accordance with art. 77 GDPR, to complain to a supervisory authority. As a rule, you can contact the supervisory authority of your usual place of residence or workplace or our office.

7. Right to object

If your personal data are processed on the basis of legitimate interests pursuant to art. 6 para. 1 sentence 1 lit. f GDPR, you have the right to object to the processing of your personal data pursuant to art. 21 GDPR, provided that there are reasons for this arising from your particular situation or the objection is directed against direct advertising. In the latter case, you have a general right of objection, which we will accept without specifying a particular situation.

8. Data security

We use the most common SSL (Secure Socket Layer) method in conjunction with the highest level of encryption supported by your browser. This is usually a 256-bit encryption. If your browser does not support a 256-bit encryption, we use 128-bit v3 technology instead. Whether a single page of our website is transmitted in encrypted form is indicated by the display of the closed key or lock symbol in the lower status bar of your browser.

We also use suitable technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or unauthorized access by third parties. Our security measures are continuously improved in line with technological developments.
